NCLAT upholds NCLT order rejecting Paradeep Phosphates' Entry Tax exemption plea

Business To Business, New Delhi, 18th May, 2026: The National Company Law Appellate Tribunal on Monday rejected a petition filed by Paradeep Phosphates Limited seeking exemption from Entry Tax in Odisha under a rehabilitation scheme sanctioned by the erstwhile Board for Industrial and Financial Reconstruction.
A two-member bench upheld an earlier order passed by the National Company Law Tribunal’s Cuttack bench, observing that the company’s claim was barred by limitation.
The appellate tribunal said Paradeep Phosphates had failed to establish grounds before the NCLT for issuing directions granting exemption from payment of Entry Tax until 2014 under the rehabilitation scheme sanctioned on September 2, 2008.
The ruling deals with claims arising from financial reliefs and concessions sought under legacy rehabilitation frameworks for financially distressed companies.
