Business To Business, New Delhi, 13th May 2026: An MP-MLA court in Uttar Pradesh on Wednesday dismissed a defamation complaint filed against Rahul Gandhi over allegations that he referred to three acquitted men as “accused”.
Additional Civil Judge Deepak Nath Saraswati rejected the plea under Section 226 of the Bharatiya Nagarik Suraksha Sanhita.
While dismissing the complaint, the court observed that summoning an individual as an accused is a “serious matter” and that criminal law should not be invoked routinely without sufficient grounds.
Section 226 of the BNSS empowers a magistrate to dismiss a complaint if, after examining the complainant and witnesses and considering any inquiry or investigation conducted under Section 225, there is no adequate basis to proceed further with the case.
