HC lifts stay on arrest warrant against Trinamool Congress MP Abhishek in defamation case
Business To Business, Kolkata, 17th June, 2026: The Madhya Pradesh High Court on Wednesday lifted the interim stay on the execution of an arrest warrant issued against Abhishek Banerjee in a defamation case, potentially adding to the legal challenges facing the senior Trinamool Congress leader.
A single bench of Justice Pramod Kumar Agarwal dismissed Banerjee's petition and vacated the interim protection that had been granted in November 2025.
As a result:
- The stay on the arrest warrant issued by a special court in Bhopal has been lifted.
- The warrant can now be executed unless Banerjee secures relief from a higher court or through other legal proceedings.
- The defamation case before the special court will continue in accordance with law.
Banerjee, who is the nephew of Mamata Banerjee and one of the party's most influential leaders, plays a key role in the organizational and electoral strategy of the All India Trinamool Congress.
The High Court's decision is therefore likely to have political ramifications, particularly as the party prepares for future electoral contests.
The ruling comes at a time when Banerjee is already facing scrutiny in other matters. Enforcement agencies have been investigating allegations linked to corruption cases, although legal proceedings in those matters are separate from the defamation case before the Madhya Pradesh courts.
Banerjee's legal team may challenge the High Court order before a higher judicial forum. Until any fresh relief is obtained, the lifting of the stay means that the arrest warrant issued by the Bhopal court is no longer protected by the High Court's interim order.
The case is expected to remain under close watch given Banerjee's prominent position in West Bengal politics and within the Trinamool Congress leadership.
