SC questions Mahua Moitra over her plea to mandate public disclosure of foreign portfolio investors

Business To Business, New Delhi, 14 October 2025: The Supreme Court on Tuesday questioned TMC MP Mahua Moitra regarding her plea seeking mandatory public disclosure of the ultimate beneficial owners and portfolios of alternative investment funds, foreign portfolio investors, and their intermediaries in India.
 
A bench comprising Justices B V Nagarathna and R Mahadevan expressed concerns over the nature of the petition, stating that a "roving and fishing" inquiry cannot be initiated through a petition filed under Article 32 of the Constitution.
 
The bench questioned the purpose of such disclosures, asking what Moitra intends to do with the information and whether it falls under the Right to Information Act, emphasizing that an Article 32 petition is not suitable for such demands.
