Business To Business, Kolkata, 5th May, 2026: Amid the political standoff in West Bengal, constitutional experts on Tuesday said Chief Minister Mamata Banerjee would have to step down following the Assembly poll defeat, or face dismissal once a new government is formed.
A day after the Bharatiya Janata Party secured a decisive majority, experts noted that the chief minister’s tenure effectively ends when the Governor invites the new majority leader to form the government and a successor is sworn in. They also pointed out that the term of the outgoing Assembly is set to expire on May 7.
Constitutional expert and former Lok Sabha Secretary General P. D. T. Achary said Banerjee would have no option but to vacate office once a new chief minister assumes charge. “There cannot be two chief ministers in a state,” he said.
